Terms of Use for Web Application

These Terms of Use govern the obligations and rights of the supplier Forscale and the User of the Web Application.

1 Definitions

1.1 Web Application : application software delivered from a server connected to the Internet and controlled from a web browser

1.2 User : person using the Web Application

1.3 Forscale : supplier of the Web Application

1.4 License : the right to use the Web Application

1.5 Trial Period : limited period during which the User can evaluate and test the Web Application in full functionality and free of charge

2 Product

2.1 Forscale provides the Web Application functionality to the User by means of a web address (URL) and after identifying the User.

2.2 The User has access to the Web Application via his own Internet connection and his own PC with a web browser. Whether the set-up of the user satisfies can be determined during the Trial Period. After purchasing the License the User bears responsibility for a suited set-up.

2.3 Forscale can deny access to the Web Application if the business License terms are not kept by the User or if the User uses the Web Application incorrect on purpose.

2.4 A Web Application by Forscale depends on third party platforms for identification, authorization, storage, security and functionality. The User must be aware of the applicable third party user terms and costs and act accordingly.

3 Identification and Authorization

3.1 The User identifies himself at the Web Application by means of his e-mail address and password in order to receive the rightful functionality.

3.2 After identification the User may be asked to grant authorization to access his third party functions and data. Without this authorization the Web Application will not function as required.

3.3 Authorization can be withdrawn by the User at any moment. Without this authorization the Web Application will not function as required.

4 Security

4.1 The User is responsible to keep his user name and password on a safe place, in order to keep the User's information private.

4.2 The data exchange between the User's web browser and the Web Application is by means of SSL encryption (HTTPS).

5 Privacy

5.1 Information which Forscale receives from the User by means of the Web Application will only be used by the Web Application itself.

5.2 Information which Forscale receives from the User by means of the Web Application will remain stored only for as long as needed.

5.3 Forscale will not access any information from the user other than required for the Web Application.

5.4 Forscale must ask the User for consent to access his information for an agreed purpose.

6 Warranty

6.1 The warranty period of the Web Application equals per User the duration of the License in case of a bound period of validity and 1 year from the date of purchase in case of an unbound validity.

6.2 The availability of the Web Application is estimated to 99,9% of the time, measured over a year.

6.3 Problems in the Web Application found and reported by the User to Forscale are resolved or worked around within a reasonable time frame.

7 No refund

7.1 Because the Web Application is provided free of charge and in full functionality during the Trial Period to allow potential customers to evaluate and test it before paying the License fee, Forscale enforces a strict no-refund policy.

8 Liability

8.1 The User remains at all times responsible for the outcome of the Web Application.

8.2 Forscale is not liable for any damage as a result of the use of the Web Application by the User.

8.3 Forscale is not liable for any damage as a result of malfunctioning of the Web Application.

8.4 Forscale is not liable for any damage as a result of temporary unavailability of the Web Application.
